Liability Waiver

By signing this document, you will waive certain legal rights, including the right to sue or claim compensation following an accident.

Releasees

Forge Hockey Development (operating as "Forge Hockey"), its partners, directors, officers, employees, coaches, contractors, volunteers, representatives, successors, and assigns, as well as all facility operators, including but not limited to Canlan Ice Sports Corp. (dba Canlan Sports), and any other municipal or private arenas where Forge Hockey conducts programming (collectively, the "Releasees").

Facility

Refers to any ice rink, off-site location, synthetic ice surface, or training environment where Forge Hockey operates.

1. Acknowledgement of Activities and Associated Risks

I acknowledge that participation in Forge Hockey programs, including on-ice training, drills, scrimmages, and off-ice conditioning involves inherent and foreseeable risks. I understand that hockey is a potentially dangerous activity. I expressly assume all risks and dangers incidental to the events, which include, but are not limited to:

• Injuries occurring from collisions, slips, trips, and falls.

• The danger of being injured by balls, pucks, hockey sticks, skates, training apparatus, nets, boards, or other players.

• Injuries ranging from minor bumps, bruises, and scrapes to serious injuries including sprains, strains, fractured or broken bones, torn ligaments, disability, paralysis, or death.

• Possible exposure to and illness from infectious and communicable viruses and diseases, including influenza and COVID-19.

I understand that all facilities and ice surfaces carry risk, and these risks may not be fully eliminated even with proper supervision and safety protocols.

Equipment Responsibility: I acknowledge that wearing full, properly fitted hockey equipment is strictly required for participation. I assume full personal responsibility for ensuring I am wearing all necessary protective gear. I understand and agree that Forge Hockey and its staff are not obligated or responsible for checking, inspecting, or monitoring my equipment prior to or during the session, and I expressly waive any claims for injuries resulting from my failure to wear complete, proper, or non-defective gear.

2. Health Declaration, Medical Consent & Record Retention

I confirm that I am physically, emotionally, and mentally capable of participating in Forge Hockey activities.

Health Declaration: I have listed any relevant medical or physical conditions below. I understand that for insurance compliance, this declaration of health concerns will be kept on file by Forge Hockey for a minimum of 4 years.

Medical Consent: I authorize Forge Hockey staff to seek or arrange emergency medical care as deemed necessary, and I accept full financial responsibility for any associated costs.

3. Waiver of Claims and Release of Liability

On behalf of myself, my heirs, next of kin, executors, administrators, and assigns, I hereby waive, release, and forever discharge the Releasees from any and all claims, demands, actions, damages, losses, expenses, or liabilities arising from or related to my participation or presence at the Facility. This includes any claims arising from negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under the Occupiers Liability Act (BC) or otherwise. This Agreement remains in effect for all upcoming Forge Hockey events and engagements unless terminated through formal written notice.

4. Indemnity & Property Damage Agreement

I agree to defend, indemnify, and hold harmless the Releasees from any liability, claims, damages, legal fees, or costs arising from my intentional or negligent acts or omissions. I also agree to pay for any damage I cause to the Facility, its equipment, or Forge Hockey property, whether intentional or accidental. I acknowledge that any personal property I bring to the Facility is at my own risk.

5. Media, Photography, and Broadcast Release

I consent to the following media and recording terms:

Facility Security & Broadcasting (Canlan Requirements): I consent to my participation being recorded through video and audio equipment and broadcasted to others for security, safety, and/or commercial purposes (such as "Canlan Sports Live"). I will not receive remuneration, and I understand this footage may be transferred to or stored in jurisdictions outside Canada and subject to non-Canadian laws.

Forge Hockey Marketing: I grant Forge Hockey permission to photograph, record, or film my participation and to use such media in training, marketing, promotional, and educational materials without compensation or restriction.

6. Behavior & Safety Compliance

I agree to follow all instructions and safety rules provided by Forge Hockey staff. I understand that unsafe, aggressive, or disruptive behavior will not be tolerated and may result in immediate removal from the Facility without refund.

7. Refund & Cancellation Policy

Standard Cancellations: Cancellations made 5 or more days before the program start date are eligible for a 100% refund. Cancellations made between 24 hours and 5 days prior are eligible for a 50% refund. Cancellations made less than 24 hours prior are not eligible for a refund.

Missed Sessions: No refunds, credits, or prorated amounts will be provided for missed sessions due to personal scheduling conflicts, voluntary withdrawal, or failure to attend.

Medical Exceptions: In the event of an injury or medical condition that prevents participation, Forge Hockey may, at its sole discretion, provide a partial or full refund upon receipt of a valid medical note.

8. Governing Law & Jurisdiction

This Agreement is governed by the laws of the Province of British Columbia. Any disputes will be resolved exclusively in the courts of British Columbia. If any portion of this Agreement is found unenforceable, the remaining sections shall remain in full force and effect.
